Terms and Conditions

These Terms and Conditions (“Terms”) govern the services provided by Pennisi Lawn & Landscape LLC (“Company,” “we,” “us,” or “our”), including the use of our website located at https://pennisilandscape.com and any lawn care, landscaping, or property maintenance services we provide.

By requesting service, scheduling work, submitting information, or making payment, you agree to these Terms.

Services

Pennisi Lawn & Landscape provides residential and commercial outdoor services including, but not limited to:

• Lawn mowing and maintenance
• Mulch installation
• Seasonal cleanups
• Leaf removal
• Shrub trimming
• Snow Removal
• Landscape installation
• General property maintenance

All services are subject to availability, weather conditions, property conditions, and operational capacity.

Pennisi Lawn & Landscape reserves the right to refuse or discontinue service at our discretion.

Estimates and Pricing

All estimates are based on the visible condition and information provided about the property at the time the estimate is issued.

Pricing may be adjusted if:

• Property size or conditions differ from what was represented
• Additional work is requested
• Obstacles, hazards, or excessive debris are present
• Access to service areas is restricted
• Conditions require additional labor or equipment

Unless otherwise stated, estimates are valid for 30 days.

Deposits

For projects with a total estimated cost of $1,000 or more, a 20% deposit is required before work is scheduled or materials are ordered.

Deposits secure your place on our schedule and allow us to purchase necessary materials.

Deposits are applied toward the total project cost and are generally non-refundable once scheduling or materials have been committed, except where required by law.

Remaining project balances are due upon completion unless otherwise agreed in writing.

Scheduling

Service dates and times are approximate and are not guaranteed.

Services may be delayed or rescheduled due to:

• Weather conditions
• Equipment issues
• Safety concerns
• Access issues
• Operational scheduling adjustments

We make reasonable efforts to complete services as scheduled but cannot guarantee specific arrival times.

Property Preparation

Customers are responsible for preparing the property before service.

This includes:

• Removing toys, hoses, furniture, and other obstacles
• Securing pets
• Marking irrigation systems, invisible fences, and underground utilities
• Removing excessive pet waste

If excessive dog waste or hazardous conditions are present, Pennisi Lawn & Landscape may:

• Skip the affected area
• Charge a cleaning or hazard fee
• Reschedule the service

Pennisi Lawn & Landscape is not responsible for damage caused by hidden hazards, unmarked utilities, invisible fences, or improperly installed irrigation systems.

Property Access

Customers must provide safe and reasonable access to the property.

If our crew arrives and service cannot be performed due to:

• Locked gates
• Loose animals
• Blocked access
• Unsafe conditions

A trip or missed service fee may apply.

Payment Terms

Payment is due upon completion of service unless otherwise agreed in writing.

We accept payment through:

• Credit or debit cards
• Online payment portals
• Other approved payment methods

Failure to pay may result in service suspension and collection action.

Late Fees

Invoices not paid within 7 days may be subject to a late fee of 1.5% per month (18% annually) or a minimum fee of $10, whichever is greater.

Accounts that remain unpaid may result in:

• Suspension of services
• Collection activity
• Reasonable collection or legal fees where permitted by law

Returned Payment Fee

Returned checks or failed electronic payments may result in a $35 returned payment fee.

Recurring Services

Recurring services such as weekly or bi-weekly lawn mowing automatically continue unless canceled.

Pricing may be adjusted with reasonable notice.

Customers must cancel before the next scheduled visit to avoid charges.

Cancellations

Customers may cancel scheduled services with reasonable notice.

If cancellation occurs after a crew has been dispatched or arrives on site, a cancellation or trip fee may be charged.

Pennisi Lawn & Landscape reserves the right to cancel services due to unsafe conditions or operational limitations.

Satisfaction and Service Issues

If you are dissatisfied with a service, you must notify us within 24 hours of service completion.

We will review the concern and may offer corrective service where appropriate.

Refunds are not guaranteed and are evaluated on a case-by-case basis.

Refunds and Chargebacks

Customers agree to contact Pennisi Lawn & Landscape to resolve service concerns before initiating a payment dispute or chargeback.

Unauthorized chargebacks may result in:

• Service suspension
• Collection action
• Additional administrative fees

Refund decisions are made at our discretion based on the circumstances of the service performed.

Weather and Natural Conditions

Outdoor services depend on environmental conditions.

Pennisi Lawn & Landscape is not responsible for results affected by:

• Weather conditions
• Drought or heavy rainfall
• Soil conditions
• Plant health issues
• Pest damage or disease

Property Damage and Hidden Hazards

Pennisi Lawn & Landscape is not responsible for damage caused by:

• Hidden or buried objects in lawns or soil
• Unmarked irrigation systems, wires, or utilities
• Pre-existing property damage
• Conditions beyond our control

Customers are responsible for clearly marking sprinkler heads, irrigation lines, and other underground systems.

Limitation of Liability

To the maximum extent permitted by law, Pennisi Lawn & Landscape’s liability for any claim related to services shall not exceed the amount paid for the specific service giving rise to the claim.

Website Use

By using our website, you agree not to:

• Use the website for unlawful purposes
• Attempt unauthorized access to systems
• Submit false or misleading information
• Interfere with website functionality

We reserve the right to restrict website access if these Terms are violated.

Communications

By providing your contact information, you consent to receive communications from Pennisi Lawn & Landscape including:

• Phone calls
• Emails
• Text messages

These communications may include service notifications, scheduling updates, and invoices.

Service Refusal

Pennisi Lawn & Landscape reserves the right to refuse or terminate services due to:

• Unsafe property conditions
• Nonpayment
• Harassment or abusive behavior
• Violations of these Terms

Governing Law

These Terms shall be governed by the laws of the State of New Jersey.

Any disputes arising from these Terms or services provided shall be resolved in the appropriate courts located within New Jersey.

Thrown Object and Debris Damage

Lawn mowing and trimming equipment may occasionally propel small debris such as rocks, sticks, or other objects that are hidden in the grass.

Pennisi Lawn & Landscape is not responsible for damage caused by objects that were not visible prior to service, including but not limited to damage to windows, siding, vehicles, fencing, or other property resulting from debris in the lawn.

Customers are responsible for maintaining a lawn that is free of rocks, construction debris, toys, metal objects, and other hazards before service.

Irrigation and Underground Systems

Customers are responsible for clearly marking all sprinkler heads, irrigation lines, drainage systems, invisible fences, landscape lighting wires, and other underground utilities.

Pennisi Lawn & Landscape is not responsible for damage to irrigation systems or underground installations that are:

Hidden below the soil surface
Improperly installed
Not clearly visible or marked prior to service

Low or protruding sprinkler heads are particularly susceptible to damage during mowing and trimming operations.

Plant Health and Landscaping Results

Plant health, turf condition, and landscaping outcomes are influenced by environmental factors beyond our control.

Pennisi Lawn & Landscape does not guarantee the survival, health, or growth of plants, grass, shrubs, trees, or landscaping materials due to factors such as:

Weather conditions
Soil quality
Watering practices
Pests or disease
Pre-existing plant stress

Recommendations provided by Pennisi Lawn & Landscape are based on experience but do not constitute a guarantee of plant performance.

Changes to These Terms

Pennisi Lawn & Landscape may update these Terms at any time.

Updated versions will be posted on our website with a revised Last Updated date.

Continued use of our services constitutes acceptance of the updated Terms.
